This is perfectly legal. The NFusion can not be used in this fashion. There is only one reason for NFusion IKS technology and that is for "Satellite Piracy."

I mentioned in the past that D*sh is going this route through court proceedings and they are going to win.

I have stated that an Australian Court has labelled a NFusion receiver a "Piracy Device"  and has no legitimate use in "True" Free-To-Air applications. Apparently a Minnasota Federal District Court agrees, as in the case involving D*sh Network versus Gustav Dobos.

Some of the highlights involving the outcome of this case are:

7. Defendant violated federal laws by offering to the public, providing, or otherwise engaging in the traffic of devices, components, and/or technologies that are primarily designed to circumvent and/or defeat Plaintiffsð€™ Security System and ultimately facilitate the unauthorized reception of Plaintiffsð€™ encrypted satellite signals and copyrighted D*SH Network Programming.

Such devices, components and/or technologies include: firmware and software designed or used for piracy in connection with FTA receivers, Internet Key Sharing, Control Word Sharing, distribution of data or code for use in piracy, and nFusion-branded FTA receivers.

Defendant acknowledges and admits that each of the foregoing was primarily designed, marketed and used to facilitate piracy of satellite television programming.

(ii) has only a limited commercially significant purpose or use other than to circumvent Plaintiffsð€™ Security System, including the encryption and access control protection contained in the software on D*SH Network Access Cards, or any other technological measure adopted by Plaintiffs that effectively controls access to copyrighted television programming on the D*SH Network platform;

What it says is this receiver was primarily made to steal D*sh Networks encrypted programming and aid others in satellite TV piracy by viewing D*sh"s signals un-encripted via IKS technology, it further goes on and says the NFusion receiver has a limited significant purpose other than to circumvent D*sh Networks security features. The defendant (Dobos) agrees.

This Court also ordered a judgment in favor of D*SH Network L.L.C (E*hoStar Technologies L.L.C. and N*graStar LLC) on each of the Plaintiffsð€™ claims and for breach of contract (Counts 1-5 in Plaintiffsð€™ Complaint) in the aggregate amount of Twenty Million Dollars ($ 20,000,000.00). And, should this defendant breach any part of this Final Judgment or Permanent Injunction, he shall be subject to damages in the amount of $110,000 for each such breach or violation.

So there is it, the NFusion branded boxes are not "True" FTA receivers, they are nothing more than "Piracy Devices" as per a Federal Courts decision. D*sh Network has been fighting for this for quite awhile and it finally got it. The $20 million is just a bonus.
